On February 20, 2026 the Supreme Court issued a decision that invalidated the Administration’s use of imposing tariff’s under the International Emergency Economic Powers Act of 1977, or IEEPA, which the Administration used to as a main tool in its tariff agenda. The act had never before been used by a president to impose tariffs. During a White House press conference the afternoon of February 20th, it was announced that to replace the loss of IEEPA tariffs, the Administration would impose a global 10% tariff using Section 122 of the Trade Act of 1974. This action allows for temporary tariffs of up to 15%, for a maximum of 150 days (note: this will be the first time Section 122 authority has ever been used). It is expected that during this time, the Administration will complete investigations and levy tariffs using Section 301 and Section 232 (further detailed below). The table that follows details tariffs by Top 10 trading partners, as well as key commodities/materials.
