In an environment of heightened scrutiny of sustainability claims in the United States, allegations of greenwashing are increasingly leading to enforcement actions that carry material legal and reputational implications. Evolving state-level requirements are also shaping expectations for how companies substantiate and communicate these claims.

This briefing, led by Weil, Gotshal & Manges LLP, will share insights from recent greenwashing litigation and unpack current trends, and translate them into practical steps companies can take to reduce exposure. The discussion will focus on what courts and enforcers are signaling now and how to structure disclosures so claims remain consistent across sources.

Discussion topics will include:

  • Litigation and enforcement developments shaping greenwashing risk in the U.S.

  • Recent high-profile cases, with practical takeaways

  • Building internal controls and cross-functional review to verify claims and ensure message consistency
